These Terms of Service ("Terms") govern your purchase and use of Homie, the WiFi home phone made by The New Home Phone. Please read them carefully, especially the Emergency Services / 911 section below — it explains important ways Homie's 911 calling differs from a traditional landline.

These Terms are a binding agreement between you and The New Home Phone ("Homie," "we," "us," or "our"), the maker of the Homie home phone. By placing a pre-order, creating an account, activating a Homie device, or otherwise using our products or services, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not place an order or use the service.
Homie is intended for personal, residential use by adults. If you are purchasing or setting up a Homie phone on behalf of a household, you represent that you are authorized to accept these Terms for every person in that household who will use the phone, and that you will pass along the notices required in Section 5 below to every household member and guest.
Homie is a landline-style home phone that connects to your home WiFi network rather than a traditional copper telephone line or wireless carrier plan. Homie's core feature is call-screening software: incoming calls are checked against a list of contacts you approve, and only approved contacts are able to ring the phone. Calls are carried using interconnected Voice over Internet Protocol ("VoIP") technology, provided through underlying communications infrastructure operated by third-party carriers, including Twilio and Telnyx (each an "Underlying Carrier"). Homie is not a traditional wireline telephone service, and its performance depends on your home internet connection, your WiFi network, and the continued availability of electrical power and the Underlying Carriers' networks.
Homie-to-Homie calling is free. An optional monthly "Everywhere" plan allows calls to and from ordinary phone numbers outside the Homie network, as described in Section 9. 911 emergency calling is provided as a standard part of the service at no additional charge, subject to the important limitations described in Section 5.
Homie is currently available for pre-order at $99, paid in full at the time of order, and is estimated to begin shipping in Fall 2026. We have a good-faith, reasonable basis for this shipping estimate based on our current manufacturing and logistics plan, but as with any hardware product in development, the exact ship date may shift.
You are entitled to a full refund of your $99 pre-order payment if any of the following applies:
To request a refund under one of the circumstances above, email hello@thenewhomephone.com or call 703-239-3162. Approved refunds are processed within seven (7) business days for non-card payment methods, or within one billing cycle for card payments, back to your original payment method.
Once your Homie has shipped, the standard return and warranty terms communicated at the time of shipment apply. Prices, features, and estimated ship dates are subject to change for future orders, but changes will not apply retroactively to an order you have already placed.
To use Homie, you will create an account and, through the Homie app, maintain the list of contacts approved to call in and out of your phone. You are responsible for keeping your account credentials secure and for the accuracy of the information you provide, including the approved-contacts list and, most importantly, your registered service address described below.
Homie provides interconnected VoIP 911 dialing as a standard feature on every plan, at no additional charge, and 911 calling cannot be disabled. However, because Homie depends on your home internet connection, electrical power, and third-party carrier networks, 911 calling may not function in the same way, or may not be available at all, under the following circumstances:
Because of these limitations, we strongly recommend that you and everyone in your household keep an alternative means of contacting 911 readily available at all times — for example, a charged cell phone — in case Homie's 911 calling is unavailable for any reason.
Before we activate 911 service on your Homie phone, you must provide us with the accurate, physical street address where the phone will be used ("Registered Service Address"). You must promptly update your Registered Service Address in the Homie app any time you move the phone to a new location, including a temporary move. Homie's dispatchable-location and 911 routing depend entirely on the accuracy of this address. We are not responsible for the consequences of an inaccurate, outdated, or unregistered service address.
You agree to inform every member of your household, and any guest, babysitter, caregiver, or other person who may use your Homie phone, of the 911 limitations described in this Section 5, including that 911 may not work during an internet or power outage, after an unregistered move, or during a service suspension. It is your responsibility to make sure everyone who may pick up the phone in an emergency understands these limitations, including keeping a cell phone or other alternative means of reaching 911 accessible in your home.
By activating your Homie phone or placing an order, you affirmatively acknowledge that you have received, read, and understood this Emergency Services / 911 disclosure, and that you accept responsibility for notifying your household as described above. We keep a record of this acknowledgment, including the date and time it was given, as required by FCC rules.
Every Homie phone ships with a printed 911 warning sticker describing the limitations in Section 5. You agree to place this sticker on or near your Homie phone, in a location where it will be seen by anyone who might use the phone, promptly after you receive it. If your sticker is lost, damaged, or missing, contact us at hello@thenewhomephone.com and we will send a replacement at no charge.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL RESPONSIBILITY FOR THE ABILITY OF HOMIE, OR ANY ASSOCIATED EQUIPMENT, SOFTWARE, OR SERVICE, TO SUCCESSFULLY CONNECT TO A 911 EMERGENCY RESPONSE CENTER, PUBLIC SAFETY ANSWERING POINT ("PSAP"), OR ANY OTHER EMERGENCY SERVICE, UNDER ANY CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO THOSE DESCRIBED IN SECTION 5. NEITHER THE NEW HOME PHONE NOR ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OR UNDERLYING CARRIERS MAY BE HELD LIABLE FOR ANY CLAIM, DAMAGE, LOSS, FINE, PENALTY, OR COST OF ANY KIND — WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE — ARISING FROM OR RELATING TO THE ABSENCE, INTERRUPTION, FAILURE, DELAY, OR MISROUTING OF 911 OR OTHER EMERGENCY DIALING SERVICE, AND YOU HEREBY WAIVE ANY AND ALL SUCH CLAIMS OR CAUSES OF ACTION, EXCEPT TO THE EXTENT CAUSED BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
Except for the 911/emergency waiver above, and to the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or relating to Homie or these Terms will not exceed the amount you paid us in the twelve (12) months preceding the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of use, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow certain limitations on liability, so some of the above limitations may not apply to you; in that case, our liability is limited to the greatest extent permitted by applicable law.
HOMIE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL PERFORM AS RELIABLY AS A TRADITIONAL WIRELINE TELEPHONE SERVICE, INCLUDING FOR 911 CALLS.
You agree to defend, indemnify, and hold harmless The New Home Phone, its officers, directors, employees, affiliates, agents, and Underlying Carriers, from and against any and all claims, losses, damages, fines, penalties, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your failure to keep your Registered Service Address accurate and current; (b) your failure to notify household members or guests of the 911 limitations described in Section 5; (c) your misuse of the service or violation of these Terms; (d) any act or omission by you or anyone using your Homie phone in connection with a 911 or emergency call; or (e) your violation of any applicable law or third-party right.
Homie-to-Homie calling is free with every device and does not require a subscription. The optional Everywhere plan allows calling to and from ordinary phone numbers outside the Homie network and is offered on two billing cycles: an annual plan at $99 per year (the default) or a monthly plan at $10 per month. Billing for the Everywhere plan begins when your Homie ships and is charged in advance for the applicable cycle. You may turn off auto-renewal or cancel the Everywhere plan at any time through your account or by contacting us at hello@thenewhomephone.com; cancellation takes effect at the end of your current billing period, and unless otherwise required by law or expressly stated at purchase, fees already paid for the current period are non-refundable. 911 calling is unaffected by your choice of plan or cancellation.
Payments are processed by our third-party payment processor, Stripe. We do not store your full payment card details ourselves. See our Privacy Policy for more on how payment information is handled.
You agree to use Homie only for lawful, personal, residential purposes. You may not use Homie to place harassing, abusive, or fraudulent calls; to make false reports to emergency services; to resell or provide the service to third parties as a commercial telephone service; or in any way that violates applicable law or interferes with the operation of the service or Underlying Carrier networks.
The Homie name, logo, app, software, and related materials are owned by The New Home Phone or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Homie app and software solely to operate your Homie phone for personal use. You may not reverse-engineer, decompile, or resell any part of the software or service except as permitted by law.
We may suspend or terminate your access to the service if you violate these Terms, fail to pay applicable fees, or if we reasonably believe your use of the service poses a risk to us, our Underlying Carriers, or other users. Suspension or termination of service will also suspend or terminate 911 calling capability, which is one of the reasons we require you to keep an alternative means of reaching 911, as described in Section 5.
These Terms, and any dispute arising out of or relating to them or to Homie, are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles, and without regard to the United Nations Convention on Contracts for the International Sale of Goods.
You and The New Home Phone agree that any dispute, claim, or controversy arising out of or relating to these Terms, your purchase, or your use of Homie — including disputes relating to 911 or emergency calling — will be resolved by binding, individual arbitration, rather than in court, except that either party may bring an individual action in small claims court if it qualifies. Arbitration will be conducted by a neutral arbitrator under the rules of a reputable arbitration organization, on an individual basis. You and we each waive any right to a jury trial and to participate in a class, collective, or representative action. Any arbitration or proceeding permitted under this section will take place in, or be based on the law of, the Commonwealth of Virginia, in or near Loudoun County, Virginia.
If any part of this arbitration agreement is found unenforceable, the remainder will still apply, and any claim not subject to arbitration will be brought exclusively in the state or federal courts located in Loudoun County, Virginia, and you consent to the personal jurisdiction of those courts. The website, products, and services are intended for and directed only to residents of U.S. states and territories other than the State of California; by accessing or using the website or placing an order you represent that you are not a resident of California and are not accessing the website from within California, and you agree, to the fullest extent permitted by law, not to bring and to waive any right to bring any claim under California law (including without limitation the California Invasion of Privacy Act) arising out of any such use.
We may update these Terms from time to time, including to reflect changes in our service, technology, or legal requirements. If we make material changes, we will notify you by email or through the Homie app before the changes take effect. Continued use of Homie after changes take effect means you accept the updated Terms.
Homie is made by The New Home Phone, founded by Devon Szklennik and based in Aldie, Virginia.
